These Terms & Conditions (“Terms”) govern your access to and use of FlowAssistant (“FlowAssistant”, “we”, “us”, “our”) including our website, dashboard, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. The Service

FlowAssistant provides tools for businesses to capture leads, manage customer conversations, and send follow-up communications (including through connected channels and email providers). Features may change over time as we improve the Service.

2. Eligibility and Accounts

• You must be able to form a legally binding contract to use the Service.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate account information and keep it up to date.

3. Connected Accounts and Integrations

You may connect third-party services (e.g., Google/Gmail, Meta, WhatsApp) to enable specific features. You authorize FlowAssistant to access and use data from those services only to provide the functionality you enable (for example, sending emails on your behalf via Gmail, or receiving/sending messages via connected channels).

You are responsible for complying with the terms, policies, and laws applicable to the third-party services you connect.

4. Customer Data and Responsibilities

You (the business customer) are responsible for the customer/lead data you collect and process through the Service, including providing required notices and obtaining any required consents for marketing and email communications.

• You must only contact people where you have a lawful basis to do so.
• You must honor opt-out requests and applicable anti-spam rules.
• You must not upload or send unlawful, harmful, or infringing content.

5. Acceptable Use

You agree not to misuse the Service. This includes (but is not limited to):

• Sending spam, deceptive, or unlawful communications.
• Attempting to gain unauthorized access to systems or data.
• Interfering with or disrupting the Service, including rate-limit bypassing.
• Using the Service to violate third-party rights or applicable laws.

6. Plans, Fees, and Billing

Some features require a paid subscription. Prices, billing cycles, and included limits (such as seats, conversations, messages, or integrations) are described in the Service or your order page. You agree to pay all applicable fees and taxes.

• Subscription fees are generally non-refundable except where required by law.
• We may update pricing or plan features with reasonable notice.
• If payment fails, we may suspend or limit access until payment is resolved.

7. Email Sending and Deliverability

If you connect an email provider (e.g., Gmail), the Service can send emails on your behalf. You are responsible for your email content and compliance. Email deliverability can be affected by recipient mail providers, spam-filtering, account reputation, and configuration. We do not guarantee delivery or inbox placement.

8. Intellectual Property

We own the Service and its underlying technology. You retain ownership of your data. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription, subject to these Terms.

9. Suspension and Termination

We may suspend or terminate access if you violate these Terms, if required by law, or to protect the security of the Service. You may stop using the Service at any time. Certain sections (such as IP, disclaimers, and liability limits) survive termination.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis. We disclaim all warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, FlowAssistant will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service.

12. Changes to the Service or Terms

We may update the Service and these Terms from time to time. When changes are material, we will provide reasonable notice (for example, by posting an updated version in the dashboard or on our website). Your continued use of the Service after changes become effective means you accept the updated Terms.
